Execution, the Florida way

Florida (Fla. Stat. § 732.502): sign your will before two witnesses.

  • Sign at the END of the will in front of two adult witnesses, who then sign in your presence.
  • Use witnesses who get nothing under the will — naming a beneficiary (or their spouse) as a witness can void that gift.
  • Add a notarized self-proving affidavit (Fla. Stat. § 732.503) so the will can be admitted to probate without tracking the witnesses down later.
  • Florida does NOT recognize handwritten (holographic) wills — it must be typed and witnessed as above.
  • Florida authorizes electronic wills (ch. 732, Part V).
  • Execution rules change over time — confirm this against Florida’s current statute, and have a licensed attorney review anything you’re unsure about.
